Global Data Strategies

The book
The paramount role of data as a resource and driver for innovation within modern digitalised societies is increasingly being acknowledged by policymakers. Consequently, states, supranational institutions, and international organisations (e.g. OSCE) find themselves in a global "competition" to devise risk-sensible approaches of data governance and thereby promote innovation to the benefit of societies. Said competition manifests in the form of Global Data Strategies, ranging between the priorities of global standard-setting and a suitable legal framework. The strategies do and will shape the political discussion in the years to come and determine both the usage of data and the associated creation of societal value. In particular, the legislative initiatives launched under the EU Data Strategy are likely to evolve into benchmarks with a global outreach.
The present work gathers contributions in English regarding Global Data Strategies along with their interdisciplinary (legal, economic, and ethical) implications. It aims to contribute to a well-founded discourse about current (and future) data strategies.
The book pursues a multidimensional approach, combining insights from academia and (governmental) practice as well as legal and economic viewpoints. Data strategies from both the ‘Global North' and the ‘Global South' are covered. The international and comparative focus allows for a discussion of regulatory convergence and dissonance.

The Genocide Convention

75 years ago, the United Nations General Assembly adopted the Convention on the Prevention and Punishment of the Crime of Genocide, the first universal human rights treaty of the United Nations era and the keystone of the international legal regime against genocide. In the second edition of their work, Lars Berster, Björn Schiffbauer and Christian J. Tams engage with the Genocide Convention’s provisions on an article-by-article basis and elucidate how they contribute to the global fight against genocide. Their Commentary offers an in-depth analysis of the Convention’s nineteen provisions. It offers authoritative guidance on the definition of genocide, on the duties of States to prevent and punish it, and on the Convention’s implementation regime.

For the second edition, the Commentary has been updated and expanded to take account of new developments, including
the rise of genocide-related proceedings before the International Court of Justice, including in high-profile cases between The Gambia and Myanmar and Ukraine and Russia;
new decisions, by national and international courts, specifying the scope of the prohibition against genocide;
recent case-law of the European Court of Human Rights bearing on genocide.
