Clinical Forensic Psychology

Islamophobia and Securitisation

This book examines how Muslim communities in the Netherlands perceive and experience extremism, counter-radicalisation policies, and Islamophobia. It is based on the findings of two original qualitative research investigations conducted in the Netherlands, in which thirty scholars, imams, mosque board members, and representatives of Islamic organisations were interviewed. The book delves into topics such as the politicisation of the Dutch media, misunderstandings about ‘radicalisation’ and how they contribute to securitisation, and how Dutch Muslims have been confronted with the dilemma of dealing with radicalisation on their own, while also facing further vilification, securitisation, and Islamophobia, all of which continue to be issues. This initiating book applies the theory of convenience to provide criminological insight into the enduring self-regulatory phenomenon of corporate compliance. Convenience theory suggests that compliance is challenged when the corporation has a strong financial motive for illegitimate profits, ample organisational opportunities to commit and conceal wrongdoing, and executive willingness for deviant behaviour. Focusing on white-collar deviance and crime within corporations, the book argues that lack of compliance is recurrently a matter of deviant behaviour by senior executives within organisations who abuse their privileged positions to commission, commit and conceal financial crime.

Law’s Memories

This book discusses the relationship between law and memory and explores the ways in which memory can be thought of as contributing to legal socialization and legal meaning-making. Against a backdrop of critical legal pluralism which examines the distributedness of law(s), this book introduces the notion of mnemonic legality. It emphasises memory as a resource of law rather than an object of law, on the basis of how it substantiates senses of belonging and comes to frame inclusions and exclusions from a national community on the basis of linear-trajectory and growth narratives of nationhood. Overall, it explores the sensorial and affective foundations of law, implicating memory and perceptions of belonging within this process of creating legality and legitimacy. By identifying how memory comes to shape and inform notions of law, it contributes to legal consciousness research and to important questions informing much socio-legal research.

This book critically examines the development of the ‘stirring up hatred’ offences which are currently found within the UK’s Public Order Act 1986. Through a critical discourse analysis of key excerpts of parliamentary Hansard, the book constructs a detailed genealogy of the offences from the perspectives that shaped them. A novel application of theory on 'myth' is used to navigate the complex arguments and to trace ideas about identity and order across parliamentary debates, from fears of Fascism in the 1930s to condemnations of homophobia in the early 21st century. The story of the stirring up hatred offences told in this book therefore extends far beyond the traditional frame of a dilemma between regulating hate speech and safeguarding free speech: it is inextricably entwined with myths about law, race and national identity, and speaks to wider themes of coloniality, neoliberalism, white entitlement, British-Christian exceptionalism and the innocence of law. Writtenin an accessible and engaging style, this book challenges a wide range of assumptions about hate speech law and raises a series of considerations for developing forms of accountability that are less complicit in the harms that they are supposed to redress.

Gender-Competent Legal Education

Male-dominated law and legal knowledge essentially characterized the whole of pre-modern history in that the patriarchy represented the axis of social relations in both the private and public spheres. Indeed, modern and even contemporary law still have embedded elements of patriarchal heritage, even in the secular modern legal systems of Western developed countries, either within the content of legislation or in terms of its implementation and interpretation. This is true to a greater or lesser extent across legal systems, although the secular modern legal systems of the Western developed countries have made great advances in terms of gender equality. The traditional understanding of law has always been self-evidently dominated by men, but modern law and its understanding have also been more or less “malestreamed.” Therefore, it has become necessary to overcome the given “maskulinity” of legal thought.

In contemporary legal and political orders, gender mainstreaming of law has been of the utmost importance for overcoming deeply and persistently embedded power relations and gender-based, unequal social relations. At the same time and equally importantly, the gender mainstreaming of legal education – to which this book aims to contribute – can help to gradually eliminate this male dominance and accompanying power relations from legal education and higher education as a whole.

This open access textbook provides an overview of gender issues in all areas of law, including sociological, historical and methodological issues. Written for students and teachers around the globe, it is intended to provide both a general overview and in-depth knowledge in the individual areas of law. Relevant court decisions and case studies are supplied throughout the book.

The book examines 'the globalization of local policing' through an ethnographic study of the Danish Police. Where many studies are looking into how larger inter- or transnational policing bodies and policies are changing the world of policing, few have gauged how local, public police forces are also globalizing. This book provides some unique insights into this under-researched process. Specifically, it describes the daily practices and perceptions of two Danish detective task forces, tasked with the investigation of organized property crimes committed by foreign nationals. In the book, readers get to see how the detectives think and work, including the many efforts they make in attuning their daily work to a more global reality. More so, readers get to see how the detectives fail and the many frustrations and concerns that such changes include. One the one hand, Danish detectives very much understand the need to de-localize and develop their work. On the other hand, they feel that many of these changes are in conflict with what they find to be real and rewarding police work. For people interested in contemporary issues of policing, the book thus points to a puzzling paradox. Globalization might be making for more mobile and even mobilised local forces, more technologically driven and collaborating with international partners. However, these very processes are also making local officers feel more disarmed than ever. Ultimately, the book describes why that is, its consequences, as well as how to imagine a form of global policing more in tune with its local actors.

Violence Against Women During Coronavirus

This open access book brings together leading international violence researchers to examine the impact of the coronavirus pandemic on experiences of, and responses to, domestic and family violence. In April 2020 the United Nations predicted that for every three months the COVID-19 lockdowns continued an additional 15 million cases of domestic violence would occur worldwide, termed the "shadow pandemic". Drawing on empirical work situated within an international context, this book presents evidence alongside country specific case studies to provide a global exploration of how women’s insecurity increased during this global health crisis at the same as their access to support services reduced. It provides a timely analysis of the degree to which the pandemic and associated government restrictions impacted on women’s experiences of violence with particular attention to changes in its prevalence and severity, and in system and service responses to women’shelp-seeking. In addition, the differential impacts of the pandemic in relation to the experiences of priority cohorts, including violence experienced by children and temporary migrant women is also explored. The key focus is on the nature, extent, and responses to the COVID-19 pandemic on service delivery, accessibility of support, and access to justice for women experiencing domestic and family violence.

The War Against Nonhuman Animals

We are currently engaged in an existential species war against nonhuman animals. This book argues that, during this war, nonhuman animals should be granted legal personhood and treated as ‘protected persons’ rather than the property of ‘protected persons.’ The main argument is that War Crimes and Crimes against Humanity – rape, forced pregnancy and other acts of sexual violence – are being committed within the meat, egg and dairy industries.

Avoiding ‘dreaded comparisons’, the book explores shared sources of oppression between human and nonhuman animals who are subject to the expressions and consequences of reproductive violence. It asks: what drives and facilitates the war against nonhuman animals? And what are the global consequences of this war? Throughout, it demonstrates how racism, sexism, and speciesism informs both intrahuman violence and the violence(s) of the animal-industrial complex. Ultimately the book asks us to reconsider what it means to be human.

Given the over-involvement of young men in crime and young men’s disproportionally high rates of reoffending, it is surprising that more research has not explored young men’s experiences of prison. This book is based on the findings of a nine-month ethnographic case study of Hydebank Wood College, a young men’s prison in Northern Ireland. It seeks to explore the complexity of gender construction and masculine performance during young adulthood, while also exposing and dissecting the turbulent social life of a young men’s prison.

In examining these themes, the book takes account of the unique social, economic, and political factors that impact young men in communities in Northern Ireland, paying particular attention to their feelings of powerlessness, marginalisation, and vulnerability, and the construction of identity in cultures defined by territorialism, violence, masculine stoicism, and an anti-authority code of ‘honour’. The book follows the formation of masculinitiesthrough the prison gate and considers how the penal environment contributes to the continual shaping young men’s identities. The book also adopts Gambetta’s concept of ‘signalling’ to examine how young men use different practices, such as language and embodiment, to communicate masculinity to their wider social audience. At the same time, it also considers the reluctance of young men to communicate about their sources of vulnerability.

This is the conference book for the XIV European Regional Congress of the International Society for Labour and Social Security Law, dedicated to the interactions between social law and other areas of law. In recent years, labour law and social security law have been subject to various reforms and developments. 2. The future in the light of the past

4. Enforcement in social law

The book explores in both theory and practice the challenges that various forms of populism pose to the dominant understandings of democratic representation and liberal constitutionalism.
