The Persecution of Children as a Crime Against Humanity

This book addresses age-based persecution of children as a crime against humanity in connection with genocide, crimes against humanity and war crimes (persecution - with some variation in the elements of the crime - is an existing offence under the Rome Statute of the permanent International Criminal Court, the statutes of various international criminal tribunals i.e. International Criminal Tribunal for Rwanda, the International Criminal Tribunal for the Former Yugoslavia and under the statutes of other international criminal courts (i.e. the  Special Court of Sierra Leone)). The book introduces a completely original concept in international criminal law, however, in discussing age-based persecution of children as an international crime against humanity where (i) the particular discrete child collective is targeted ‘as such’ for international atrocity crimes or (ii) individual children are targeted based on their age-based group identity as it intersects with other perpetrator – targeted characteristics such as gender, ethnicity, religion etc.

Sex Work and Hate Crime

This book brings together literature, empirical research findings from two projects, and policy analysis to examine how some forces in England have adopted the approach of treating crimes against sex workers as hate crimes. This book identifies some of the benefits of the hate crime approach to crimes against sex workers, both operationally and for some of the victims of crime. The authors argue that the hate crime approach should not be seen as an alternative to decriminalisation of sex work but can provide a pathway to achieving more sensitive but robust policing of crimes against sex workers and support in accessing justice through the criminal justice system. A West African Model to Address Human Trafficking

This book describes the nature of trafficking in persons in West Africa, focusing on labor and sexual exploitation in the region, and recommends tailor-made solutions established by the Catholic Church in light of governmental authorities’ failure to effectively combat this scourge of humanity. While states’ efforts to fulfill their international obligations in developing anti-trafficking legislations are recognized, their failure to carry out prosecutions of offenders and ensure protection of the victims reveals that law alone is not a sufficient instrument for realizing human rights and improving people’s lives. Faced with the sobering background of less than successful efforts by governmental entities to end the trade in humans, this research study recommends adopting essential elements of Catholic social teaching, which rests on the inherent dignity of human beings allowing the development of political, socio-cultural, and religious reforms that will increase the effectiveness of existing legislation designed to combat trafficking. This faith-based approach highlights the role that religion may play in fulfilling the discretionary provisions of the Palermo Protocol by promoting the welfare and protecting the life and dignity of the victims. Additionally, religion is composed of sound moral ethics that determine people's behavior to refrain from the sinful conduct of trafficking. It also creates a sense of ethical responsibility that promotes supply chain transparency and ethical purchasing as well as advocating social reforms and anti-trafficking legislations initiatives. In fact, the author's approach, may be a model for other regions in the world and will be of interest to scholars, law and policy makers, human rights advocates and law enforcement agents working in the field of trafficking in persons.

Police-Citizen Relations in Nigeria

This book offers an historical and contemporary analysis of policing and police-citizen relations in Nigeria, to understand why people co-operate (or don’t) with the police. It examines police legitimacy and the validity of procedural justice theory in a post-colonial African context where corruption, brutality and lack of accountability are not uncommon, to find more refined and alternative answers to the question of why people co-operate (or don’t) with the police. The history of policing in Nigeria is explored first and then procedural justice theory is tested through an extensive, cross-sectional survey of the public. One of the core findings is that citizens’ co-operation with the police is driven less by legitimacy but more by effectiveness considerations and “dull compulsion”, a concept akin to legal cynicism. This study represents one of the first attempts to test and understand “dull compulsion” and its relevance in this context. Overall, it develops the field by illustrating that that there are significant variations between contexts when addressing the influence of perceived procedural justice policing on perceptions of police legitimacy, and it explains the implications for policy makers.

The European Arrest Warrant and EU Citizenship

This book offers an in-depth analysis of the relationship between EU citizenship, the European arrest warrant (EAW), and the legality principle. It focuses on the role of the EAW in relation to two foreseeability problems with which EU citizens – especially those who exercise free movement rights – could be confronted. These problems concern the foreseeability of specific national criminal laws at the time of the offense on the one hand and forum decisions on the other. The first part of the book addresses the extent to which these foreseeability problems and the role of the EAW therein are viewed as legality problems at the EU level and in three national legal orders (the Netherlands, Germany, and England and Wales).

In turn, the second part of the book critically examines the current scope and content of the legality principle in light of the EU’s objective to offer its citizens an Area of Freedom, Security and Justice (AFSJ) in which both safety and free movement are guaranteed. As EU citizens often encounter foreseeability problems when exercising their free movement rights, it is argued that they should be protected by a transnational framework of fundamental rights. The book subsequently makes recommendations for a transnational interpretation of the legality principle, one which fits the normative context of the AFSJ as described in Article 3(2) TEU. On the basis of the evolution of EU citizenship over time, the book also develops two EU citizenship narratives and explains how they could contribute to transnational fundamental rights protection and a solution to foreseeability problems. With regard to arriving at concrete solutions, the book offers recommendations for EU legislation that could adequately remedy foreseeability problems and the role of the EAW therein.

Transcending Member States

This book explores innovative and context-driven political and legal policy measures designed to expand the powers of the African Union (AU) in order to meaningfully drive the continental integration process. In this regard, the book addresses issues of context, political will, and innovative and inclusive approaches as essential elements that must be considered. 

Africa is currently experiencing one of the most critical phases of its integrative development. Since 2015, there have been increasing efforts to develop policies and practices that grant the AU broader powers to coordinate and create binding rules regarding the regional integration process. In other words, these processes seek to endow the AU with supranational powers like those exercised by the European Union, which, despite its internal problems, remains the most successful experiment in supranationalism in the world.

This has included the decision to finance the AU through a 0.2% tax on eligible imports into member states; the decision to reduce the number of AU Commission portfolios from eight to six; the adoption and entry into force of the much touted Agreement establishing the African Continental Free Trade Area; the adoption of the Protocol to the Treaty Establishing the African Economic Community Relating to Free Movement of Persons, Right to Residence and Right of Establishment; and the adoption of the AU Agenda 2063 policy framework in 2015. How these processes will change the direction of regional integration in Africa, the book argues, largely depends on the existence of quality-driven institutions.

Sex as Work

This book examines the ways that brothels are managed under decriminalisation in New Zealand. New Zealand decriminalised sex work in 2003 with the passage of the Prostitution Reform Act, making it the first country to do so. Decriminalisation situates brothels as ‘businesses like any other’ and creates a legislative platform for better working conditions for sex workers. Nevertheless, we have limited understanding of how brothels are managed in New Zealand. Drawing on interviews with brothel operators and sex workers, this book explores how the law is understood and implemented, how brothel operators position their businesses, and how they seek legitimacy in a historically stigmatised sector. It also examines the rules and norms by which operators manage their businesses and the possibilities for sex workers to consent to commercial sexual services in the context of neoliberal norms of work and of managers who expect them to be professionalised, responsibilised and productive.

Continuing from the volume Collaborating Against Child Abuse (2017) which examined the process of Barnahus’ diffusion in the Nordic countries, the current book digs deeper into the intrinsic institutional tensions of the model, as well as those that might arise during collaboration, in order to advance our understanding of what can be achieved through the model and thus improve the situation of child victims of violence and abuse. An institutional perspective is used in the book which is structured in four parts. Using in-depth interviews with thirteen families of those individuals who were abducted, murdered and secretly buried from the 1970's onwards, this book examines the experience of the families and communities left behind. Through an exploration of the historic and cultural origins of the contemporary IRA and how they came to be in the position of power within Catholic/Nationalist communities during the troubles, the context to the disappearances are presented. This book reviews the journey undertaken by the families, from the initial disappearance of their loved one and the suffocating silence that followed, through their coming together as a self-help group. It follows their lobbying on a national and international basis leading to the return of the bodies of some of their loved ones and the solidarity which leads them to fight on as a group to recover the bodies that remain missing. It also examines the involvement of the British and Irish and American governments in the set up of the International Commission for the Location of Victim's Remains and tells the story of the Clinton's personal involvement in supporting the families in their ongoing quest for recovery. It is written accessibly for researchers and practitioners.

The book highlights the risk to a democracy of recasting fundamental human rights litigation as essentially nothing more than the sorting out of political quagmires and cultural conflicts best left to the discretion of government rather than the courts. Then, the major risk is that constitutional controversies will increasingly not be decided by an independent judiciary but rather by self-interested politicians as the courts more often than not decline to weigh in on highly sensitive human rights controversies. A further risk is that instead such cases will be decided through a judicial majoritarian political lens rather than a largely apolitical consensus judicial opinion constructed by both philosophically left leaning (so-called liberal) and right leaning (so-called conservative) jurists.

Exploring Corporate Human Rights Responsibilities in OECD Case Law

This open access book consolidates a collection of scholarly papers presented at the academic conference titled "Corporate Human Rights Responsibility in OECD Case Law: Actors, Issues, Responsibilities, and Remedies", held on 4 and 5 May 2023. The conference was organized by the OECD Case Law Project at Friedrich-Alexander-Universität Erlangen-Nürnberg.

The first examines how NCP cases interpret corporate responsibilities, including financial institutions, on human rights and environmental issues, focusing on climate change and conflict-affected zones. It also highlights how OECD cases address corporate accountability and its impact on the revised OECD Guidelines and the EU Corporate Sustainability Due Diligence Directive (CSDDD).

The second section critically evaluates the NCP mechanism's effectiveness, assessing whether it provides substantive remedies and how well NCP mediation resolves disputes. It offers both quantitative and qualitative analysis of the grievance processes in line with UNGP effectiveness criteria.

Legal Agreements on Smart Contract Platforms in European Systems of Private Law

Blockchains and smart contracts are emerging technologies that pose unique challenges for legal systems. This book outlines the extent to which these new and innovative technologies could have potentially disruptive effects on contract law in Europe. It does so through a comparative, three-part analysis of the recognisability and effects of smart contracts in European legal systems. First of all, in light of the technologies’ transboundary nature, the book employs a comparative approach, considering French law, German law, English law, and Dutch law to analyse the impact on the different systems of contract law. While doing so, it also addresses the formation, interpretation, and vitiation of contracts. Secondly, it analyses the impact of these technologies on European laws regarding unfair terms in consumer contracts and argues that the existing rules should be applied to smart legal agreements in business-to-consumer relations. Lastly, it analyses the current European rules of private international law on the basis of which jurisdiction and applicable law are developed. In this respect, the book concludes that the vast majority of these European rules are “smart contract-proof”.

This volume addresses contemporary challenges, enabled by modern technology, that concern upholding freedom of speech where it conflicts with social rights, such as respect for private and family life, and with economic rights, such as the freedom to conduct business or the right to free movement.

In today’s networked world, technological shifts happen faster than most people even realize. Some of these shifts have made us all potentially powerful: media powerful. We used to sit in silence in front of newspapers and TV screens, and the world was explained to us by just a few sources. Today, thanks to the Internet, social media, and Web 2.0, we can not only share our own thoughts with everyone in a more self-determined way, but we can also take part in public debate and even co-shape it ourselves. Of course, the Internet is not a counter-design to the communication (power) structures of the past. Gains in communicative self-determination are threatened due to algorithmisation, platformisation, and value extraction from self-created private markets.

At the same time, the empowerment of the individual challenges the old “grand speakers” who are suddenly detecting “fake news”, echo chambers, and filter bubbles everywhere on the Internet. Internet-based communication allegedly hinders us from the “one truth”; as if newspaper hoaxes, propaganda, and narrow-mindedness were an invention of the Internet. The current heated debate over “fake news”, copyright, and “upload filters” shows that we are unsure of how to deal with the newer and more complex phenomena of Internet-based speech. This is due in no small part to the fact that an important benchmark – our constitutional compass – is still firmly rooted in the past. Constitutions change far more slowly than technologies. Societal changes can drive constitutional changes; but what about normative content control?

Today, there are already demands for “old-school clarity”: truth filters on social media platforms, horrendous sums of liability for platforms that encourage (overly)thorough cleaning up. However, it is equally true that private individuals “regulate”: they decide what is found on the Internet and who may post on a given platform. Accounting for all interests at play and striking a “fair” balance that avoids both a public and private over- and under-regulation is a complex matter. The authors of this volume not only provide reflections in their highly topical contributions, but also share their understanding of what constitutes a fair balance within the larger frame of freedom of speech in a digital age.
