Oscillating between de facto control and normative responsibility, the doctrine of control over the act lacks an action-theoretical foundation. It is an attribution theory that advocates a restrictive concept of perpetrator on the basis of an extensive concept of action. This doctrinal building collapses when one considers that even the »agent of action« can lose control of one's own actions. Therefore, an action-theoretical reformulation of the theory of joint action is necessary.
