Öffentlichkeit als Verfassungsprinzip

»Publicity as a Constitutional Principle«: The term ›Öffentlichkeit‹ (publicity) appears in the text of the German Basic Law only when referring to its exclusion. Nevertheless, the publicity of state power is unquestionably a fundamental functional condition of the state, relating to various constitutional principles. This work attempts to methodically justify an unwritten norm of constitutional law and examines its relationship to legitimate secrecy, the fundamental right to freedom of information, and the German Freedom of Information Act.
